Privacy Policy

Welcome to The Plan Collection’s privacy policy. The Plan Collection respects your privacy and is committed to protecting your personal data.

 

1. Introduction

This privacy policy (“Privacy Policy) tells you how The Plan Collection uses your personal data when you visit our website, interact with us, and buy our goods and services (collectively, the “Services”).

It also tells you about your privacy rights and how the law protects you.

In this Privacy Policy, we use the word “Data” to describe all the information we collect that relates to you and your use of our Services. “Data” is broken into different categories which are defined further below, but when we use the word “Data” we mean all the different categories described in this Privacy Policy. The term “Data” does not apply to de-identified and aggregated data that may be derived from Data, such as traffic patterns, search activity, and other information that cannot be reasonably connected with an individual (“De-Identified Data”). We may use De-Identified Data for our own purposes in any manner and without attribution or compensation to any person.

It is important that you read this privacy policy, together with any other policies we may provide (such as our “Terms and Conditions” and "Copyright Law"), so that you are fully aware of how and why we are using your data.

2. Our website and The Plan Collection, LLC

Our website at www.theplancollection.com markets sells goods and services which are aimed at individual customers and business customers. This website is not intended for children and we do not knowingly collect data relating to children.

The Plan Collection’s legal entity is: The Plan Collection, LLC located at 670 White Plains Road, Suite 101, Scarsdale, NY 10583, United States. (“TPC”, the “Company”, or the “Site”)

 

3. Why are we collecting your personal information?

We require your information for:

  • Products or services you buy with us;
  • To provide you with offers and marketing information about products in which you may be interested;
  • For our monitoring of the use of the Site by users;
  • For profiling purposes so we can better tailor the Site’s content to users' browsing behavior; and
  • To conduct customer surveys in relation to our products and services.

 

4. What type of personal information do we collect?

We are collecting information about you in order to achieve the purposes set out above (see 'Why are we collecting your information?'). This includes:

Personal details and payment

  • Personal details (such as first and last name);
  • Contact details (such as your address, phone number and email address if provided);
  • Payment information (such as payment methods, billing address details and other information related to payment. Please note the Site does not retain or store credit card, debit card or other confidential payment information).

Website use and communications

  • Details of any contact with our support or customer services teams (such as a record of your written correspondence with us or telephone conversations);
  • Information about your use of our information and communications systems;
  • Browser information and online identifiers (such as your browser types, browser version, host operating system, browser language, and your IP address);
  • Information about your visit to the Site (such as full Uniform Resource Locators (URL), clickstream to, through and from our site, products viewed or searched for, page response times, download.)

Marketing, competitions and survey information

  • Competition entries;
  • Your responses to our surveys;
  • Details of any agreement or objection to receiving marketing information from us.

 

5. How is your Data collected?

We use different methods to collect Data from and about you including through:

Information provided by you. We refer to this information as “Order Information.” This includes:

  • Create an account on the Site.
  • Subscribe to the Site’s newsletter(s).
  • Make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information, email address, and phone number.
  • Report a problem with our site and/or your order.
  • Contact our support or customer service teams.
  • Complete surveys or request information on our Site.

Information collected automatically. We refer to this automatically-collected information as “Device Information.” This includes:

  • When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device.
  • Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site and information about how you interact with the Site. We may also collect information when you click one of our adverts (including those shown on third party websites).

We collect Device Information using the following technologies:

  • “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
  • “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

When we talk about “Personal Information” in this Privacy Policy, we are talking about Device Information and Order Information.

 

6. How we use your Data

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use this Order Information to:

  • Communicate with you;
  • Screen our orders for potential risk or fraud including through the use of third party fraud prevention services; and
  • When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • Where we need to comply with a legal or regulatory obligation. For example, we retain records of our sales for the purpose of tax compliance.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

Generally, we do not rely on consent as a legal basis for processing your personal data other than where the law requires it, for example in relation to sending certain direct marketing communications. Where our legal basis is consent, you have the right to withdraw consent at any time.

 

7. Sharing your Data

We share your Data with third parties to help us use your Personal Information, as described above.  For example, we share your Personal Information with our vendors to complete order fulfillment.

We use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. 

Finally, we may also share your Data to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful requests for information we receive, or to otherwise protect our rights.

 

8. What may happen if you do not provide your Data?

Many of the Services that we offer are only made available if we have certain information about you. To access these Services, you will, from time to time, be asked to submit personal data about yourself.

If you do not provide the Data, we will not be able to offer the Services to you. For example, if you do not provide information about your method of payment or delivery address, we will not be able to complete your order with us.

 

9. Behavioral advertising

10. Do Not Track

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted (see further below). If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.  Additionally, please note that your information will be transferred outside of Europe, including Canada and the United States.

 

11. Security of your Data

We have put in place appropriate security measures to prevent your personal Data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed.

In addition, we limit access to your Data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.

 

12. Third-party links

The Site may contain links to other websites, plug-ins, and applications - each with their own privacy policies. Please be aware that we are not responsible for the content or privacy policy practices of such sites. We encourage our users to be aware when they leave our site and to read the privacy policy statements of any other site that collects personally identifiable information.

 

13. Data retention

We will only retain your personal Data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. For example, details of your orders will be kept for as long as we need to retain that data to comply with our legal and regulatory requirements.

In some circumstances, we may anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

 

14. Privacy for EU Residents

The General Data Protection Regulation made effective in Europe on May 25, 2018 (“GDPR”) requires that we clearly describe to data subjects the data we collect and how we use that data.  This Privacy Policy does that, and we hope that if you have any questions for us regarding our data collection, you will write to us at [email protected].

The GDPR also requires that we have a lawful basis for our processing of any personal data about an individual residing in Europe.  For an individual browsing our website or otherwise accessing our Site, our lawful basis is our legitimate interest in providing the Site to you in the manner that you desire, and all the Data that we collect from such individuals will be used only for those purposes, as described in this Privacy Policy.  For an individual purchasing products from us, our lawful basis is the contract under which you purchase products, and the Data we collect from such individuals will be used only in connection with our contractual relationship with you and only in a manner that furthers the purposes of that contractual relationship, as set forth in this Privacy Policy. 

For employees and other authorized users operating in their role as administrators or users of our services, our lawful basis is the legitimate interest we have in providing the services to their employer. The GDPR also requires us to take appropriate technical and organizational measures to protect the security of Data relating to residents of Europe.  We make commercially reasonable efforts to ensure the privacy and security of the Data of our European visitors and customers.

Pursuant to the GDPR, residents of Europe have the right to obtain our confirmation of whether we maintain personal information relating to them in the United States. If you are a resident of Europe, upon request from you, we will provide you with access to the Data that we hold about you. You may also correct, amend, or delete the Data we hold about you, subject to our rights and obligations under the GDPR, as described in this Privacy Policy. Individuals who seek access, or who seek to correct, amend, or delete Data transferred to the United States, should direct their queries to [email protected].  If requested to remove Data, we will respond within a reasonable timeframe.

 

15. Privacy for California Residents

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. 

California has also adopted the California Consumer Privacy Act (“CCPA”), effective January 1, 2020.  TPC complies with the requirements of the CCPA to the extent they apply to the Company. 

If you are a California resident and TPC qualifies as a “business” under the terms of that law, you will have the following rights: 

- You have the right to request that we disclose or provide you with access to the specific pieces of personal information we have collected about you in the preceding 12 months. 

- You have the right to request that we delete the Data we collect from you. However, in certain situations, we are not required to delete your Data, such as when the information is necessary in order to complete the transaction for which the Data was collected, to provide a good or service requested by you, to comply with a legal obligation, to engage in research, to secure our websites or other online services, or to otherwise use your personal information internally in a lawful manner that is compatible with the context in which you provided the information. 

- You have the right not to receive discriminatory treatment by us for the exercise of any privacy rights conferred by the CCPA, which means that we will not take any action to hurt or punish you for exercising your rights under the CCPA. 

To make any request under the CCPA, please email us at [email protected]. Please provide us with your name, e-mail address, telephone number, IP address, and any other information we request to reasonably verify your identity. We will respond to your request within 10 days after receipt of your request, and we will then take action to verify your identity and fulfill your request, as required by the CCPA. You may also authorize someone else to submit these requests on your behalf. California residents who are unable to review or access this Privacy Policy due to a disability may call us at 1-866-787-2023.

 

16. Age of consent

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

 

17. Changes to this Privacy Policy

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
